What these terms cover

These terms govern your use of polluxdev.com. They are not a contract for work. If we build something for you, that engagement is governed by the written quote or agreement we sign for it, which takes precedence over anything on this page. Our apps on the Shopify App Store are governed by the terms of that listing and Shopify's own agreements.

In case of conflict, theGerman version of these termsprevails.

Using this website

You may read this site, and print or download pages from it for your own private, non-commercial use. You may not copy our text, code, images or page designs for use elsewhere without our written permission, scrape the site in bulk, or attempt to interfere with how it runs.

Nothing here is a binding offer

The service descriptions, prices and availability on this site are an invitation to enquire, not a binding offer. Booking a call, sending an email or filling in a form does not create a contract and does not oblige either of us to anything.

How a contract for work comes about

We scope work in writing. After we have discussed what you need, we send a quote setting out the scope, the price, the assumptions and the timeline. A contract comes into effect when you accept that quote in writing — email is enough. Anything not written into the quote is not part of the agreement, and changes to an agreed scope are quoted separately before we start on them.

Our Shopify apps

Our apps are distributed through the Shopify App Store. Installation, billing, cancellation and refunds are handled by Shopify under Shopify's terms and the terms shown on the app listing. These website terms do not change any of that. We support the apps as described in their listing and documentation.

Intellectual property

The content of this site — text, layout, code and images — belongs to us or to the parties who licensed it to us, and is protected by German copyright law. The name pollux|dev and our logo are ours. Rights to work we build for a client are transferred as set out in the agreement for that project, not by this page.

Availability

We would like this site to be available all the time, but we do not guarantee it. It may be unreachable during maintenance, or because of problems at our hosting provider or elsewhere on the network. We may change, restrict or withdraw pages at any time. This paragraph is about the website; availability commitments for a project or an app are made in the agreement for that project or in the app's listing.

Links to other sites

Where we link to a site we do not run, we have no control over what is on it and take no responsibility for it. The operator of that site is responsible for its content. If you tell us about an unlawful link, we will remove it.

Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and where liability is mandatory under the German Product Liability Act.

For slight negligence we are liable only where we breach an obligation whose fulfilment is essential to the purpose of the contract and on which you may reasonably rely. In that case our liability is limited to the foreseeable damage typical for this kind of contract. Any liability beyond that is excluded.

We accept no liability for the accuracy, completeness or currency of the information on this site, and none for decisions taken on the basis of it. Nothing here is legal, tax or financial advice.

Changes to these terms

We may change these terms when the site or our services change. The version published here at the time you use the site is the one that applies, and the date at the top shows when it last changed. Changes do not affect a project agreement already in place.

Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is Hannover, Germany. Mandatory consumer protection provisions of the country you live in remain unaffected.

Severability

If any provision of these terms is or becomes invalid, the remaining provisions stay in force.
